Applicants wanting to extend a spouse visa need to prove they still meet the Spouse visa financial requirements. This means:
- If your initial spouse visa was granted before 11 April 2024, you have a combined income with your partner of at least £18,600; or
- If your initial spouse visa was granted after 11 April 2024, you need a combined income with your partner of the new £29,000 threshold.
The financial requirement can be met in a number of ways, including income from employment or self-employment, cash savings, pensions, or rental property income.
The financial requirements are very complex, especially if your income is from self-employment or based on savings, pensions or rental income. These incomes are based on your ‘net’ after tax income, whereas income is based on your gross ‘pre-tax’ or gross income.
In certain circumstances you can even rely on certain (limited) state benefits, as a source of income. Most state benefits are not accepted and will in fact lead to a refusal of your application. However; Disability Living Allowance or Carer’s Allowance (higher limits) are acceptable as sources of income.
If your income falls short of the threshold, we can use your savings to make up the difference. However; that is a complex method of calculation and not all savings are acceptable. You need at least £16,000 of savings and it must not have been touched for at least the past 6 months.
